I'm Ashley Strauss Martin attorney for the Realtors Association of New Mexico, and today I'm here to talk to you about a new form we've added to the random forms library the lease listing agreement random form three zero five random form three zero five is new and the form may be used when an owner wishes for a broker to find them a tenant but does not want the broker to provide property management services there are some important things to note about this agreement first the term of the agreement paragraph 3 may be automatically extended for one-month periods after the initial term by agreement of the parties second though not its primary purpose the lease listing provides for broker compensation in the event the owner decides to sell the property during the term of the lease listing if no sales commission is set forth in the agreement then the sales commission shall be equal to the broker's standard sale Commission paragraph 5c provides that the owner removes the property from the market the owners required to pay an agreed-upon amount to the broker such amount will be deducted from the commission owed to the broker in the event the property is subsequently leased or sold during the term of the agreement or during the protection period paragraph 8 covers lease extensions or renewals paragraph 9 sets forth owner authorization looks similar to what we have in the exclusive right to sell listing agreement paragraph 10 is an explanation to the owner that the broker may have other similar properties that he is listed for sale or lease or which are listed with other brokers and that the listing broker may show those properties to potential tenants paragraph 16 allows the broker to add on to the end of the term any amount of time during which the owner has removed the property from the market due to a pending transaction this extension shall not exceed 180 days paragraph 17 sets forth the protection period and works differently than the residential resale listing agreements protection period under this paragraph the broker has 15 days from the expiration of the term to provide that owner with a list of persons June of the broker has introduced the property the owner agrees to pay the broker compensation if any of those persons should or purchase the property within 120 days it is important to note that under paragraph 18 and unlike our residential rental listing agreement the protection period does not end when or if the owner lists the property with another broker paragraph 19 to 21 addresses bankruptcy foreclosure and receivership paragraph 22 pertains to notices and should be reviewed thoroughly paragraph 27 provides for a 10 percent lay charge for all monies due to the broker that are not paid within 10 days of the due date remaining paragraphs are boilerplate in other words standard provisions found in most contracts for more information please call the random legal hotline in Albuquerque at 8 to 1 1 5 8 3 or statewide at eight seven six nine...
